Terms of service
Version as at 31 August 2026. These Terms and Conditions apply to all orders placed through the online shop at hello-oskar.com, operated by GIS House and Garden Internet Shop GmbH.
§ 1 Scope and contracting parties
(1) These General Terms and Conditions apply to all contracts for the supply of goods concluded by a consumer or business customer (hereinafter referred to as the “Customer”) with GIS House and Garden Internet Shop GmbH, Rathausstraße 4, 20095 Hamburg (hereinafter referred to as “OSKAR”) through the online shop at hello-oskar.com.
(2) A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). A business customer is a natural or legal person or a partnership with legal capacity who, when concluding the contract, acts in the exercise of their trade, business or profession (§ 14 BGB).
(3) The incorporation of any terms and conditions of the Customer that conflict with or deviate from these Terms and Conditions is rejected unless their application has been expressly agreed to in writing.
§ 2 Conclusion of the contract
(1) The presentation of products in the online shop does not constitute a binding offer, but a non-binding invitation to the Customer to order goods (“invitatio ad offerendum”).
(2) By clicking the “Order with obligation to pay” button (or a button with comparable wording), the Customer submits a binding offer to conclude a purchase contract for the goods contained in the shopping basket.
(3) OSKAR will confirm receipt of the order without delay by email (“Order confirmation”). This order confirmation does not yet constitute acceptance of the offer unless this is expressly stated. The purchase contract is concluded only when OSKAR accepts the offer in a separate email (order confirmation/despatch confirmation) or delivers the goods.
(4) We store the contract text and provide it to the Customer in text form (e.g. by email), together with these Terms and Conditions, after the contract has been concluded. The contract text cannot subsequently be accessed through the customer account if no customer account has been created.
(5) The contract language is German.
§ 3 Right of withdrawal
Consumers have a right of withdrawal in accordance with the separate withdrawal instructions available on the website at hello-oskar.com/policies/refund-policy, which form part of these Terms and Conditions. Only the current version of the withdrawal instructions published there applies.
§ 4 Prices and payment terms
(1) All prices shown are final prices and include statutory VAT. Any additional delivery and shipping costs are shown separately on the relevant product page or, at the latest, during the ordering process before the order is placed.
(2) Payment may be made using the following methods: advance payment, credit card, PayPal, purchase on account, instalment purchase (easyCredit, Klarna).
(3) We use the following payment service providers to process payments:
- Stripe: credit card payments
- Shopify Payments: credit card payments
- Klarna Bank AB, Stockholm: purchases on account and instalment purchases
- PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg: PayPal payments
Further information on the processing of personal data during payment can be found in our Privacy Policy.
(4a) If the Customer selects the “Instalment purchase” payment method, the separate terms and conditions of the financing partner TeamBank AG (ratenkauf by easyCredit), Beuthener Straße 25, 90471 Nürnberg, also apply. These must be presented separately to and accepted by the Customer during the ordering process. In this respect, OSKAR acts solely as an intermediary.
(4b) If the Customer selects the “Klarna instalment purchase” payment method, the separate terms and conditions of the financing partner Klarna Bank AB, Postfach 900162, 90492 Nürnberg, also apply. These must be presented separately to and accepted by the Customer during the ordering process. In this respect, OSKAR acts solely as an intermediary.
(5) The purchase price becomes due for payment upon conclusion of the contract unless otherwise indicated by the order processing procedure. If the “Purchase on account” or “Instalment purchase” payment method is selected, the purchase price must be paid within the period stated on the invoice.
(6) If the Customer defaults on a payment, the statutory provisions apply (§§ 286 ff. BGB).
§ 5 Delivery and shipping terms
(1) Delivery will be made to the delivery address provided by the Customer. Due to their size/weight, chimney components and wood-burning stoves are primarily shipped by freight carrier, while smaller accessories are sent by parcel service.
(2) Unless otherwise stated, the delivery time is 2–7 working days within the EU from conclusion of the contract or, in the case of advance payment, from receipt of payment in full.
(3) If the ordered goods are unavailable because our supplier fails to supply them to us on time despite a congruent covering transaction having been concluded in good time, we will inform the Customer without delay and notify them of any extended delivery period. If the goods are permanently unavailable, we will refund any payments already made without delay.
(4) Collection is available by appointment.
§ 6 Retention of title
The goods supplied shall remain the property of OSKAR (GIS House and Garden Internet Shop GmbH) until the purchase price has been paid in full.
§ 7 Transfer of risk
(1) In contracts with consumers, the risk of accidental loss of or accidental damage to the goods sold shall, including in the case of a sale involving shipment, pass to the customer only upon handover of the goods, unless the customer personally commissions a transport company not designated by the seller.
(2) In contracts with businesses, the risk of accidental loss of or accidental damage to the goods shall pass to the customer upon handover or, in the case of a sale involving shipment, upon delivery of the goods to the forwarding agent, carrier or other person or institution appointed to carry out the shipment.
§ 8 Warranty
(1) The statutory rights in respect of defects shall apply. For consumers, the limitation period for claims concerning defects in newly manufactured items is two years from delivery of the goods (§ 438 Abs. 1 Nr. 3 BGB). Consumers also benefit from the presumption under § 477 BGB, according to which a material defect that becomes apparent within one year of delivery is presumed to have existed when the risk passed, unless this is incompatible with the nature of the item or the defect.
(2) For businesses, the warranty period for newly manufactured items is one year from delivery of the goods; the warranty for used items is excluded in relation to businesses.
(3) If the item supplied is defective, the customer may choose to request subsequent performance either by rectification of the defect (repair) or by delivery of an item free from defects (replacement). If subsequent performance fails, the customer may, in principle, choose to request a price reduction or withdraw from the contract.
(4) Any claims by the customer under guarantees shall additionally be governed by the respective guarantee conditions of the manufacturer or guarantor, where a guarantee has been provided.
(5) Entering a configuration in the chimney configurator is not a substitute for professional planning. Before the chimney is put into operation, it must be inspected and approved by the local chimney sweep.
§ 9 Customer reviews
(1) We publish customer reviews of our products on our website.
(2) We ensure that published reviews come from consumers who have actually purchased the reviewed goods by inviting only customers who have completed an order with us to submit a review by email after their order. Reviews may be submitted only through this individual invitation; we do not provide a publicly accessible review form that is not linked to an order.
(3) We also match incoming reviews to the relevant order and remove reviews containing inappropriate content (e.g. insults, unlawful content or third-party advertising). Factual reviews, including negative reviews, are not removed.
(4) Further information on the processing of your data in connection with customer reviews can be found in section 9.6 of our Privacy Policy.
§ 10 Liability
(1) Our liability shall be unlimited where the cause of the damage is intentional or due to gross negligence, in the event of injury to life, limb or health, under the German Product Liability Act and to the extent of any guarantee provided by us.
(2) In the event of a slightly negligent breach of material contractual obligations (cardinal obligations), the fulfilment of which is essential for the proper performance of the contract and on compliance with which the customer may ordinarily rely, our liability shall be limited to the foreseeable loss typical of this type of contract at the time the contract was concluded. Liability for other slightly negligent breaches of obligations is excluded.
§ 11 Dispute resolution
(1) The European Commission discontinued its online dispute resolution platform (ODR platform) on 20 July 2025 (Regulation (EU) 2024/3228); accordingly, a link to it is no longer required.
(2) We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body within the meaning of § 36 VSBG.
§ 12 Final provisions
(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law shall apply only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, our registered office shall be the exclusive place of jurisdiction for all disputes arising from this contract.
(3) If individual provisions of these Terms and Conditions are or become invalid, this shall not affect the validity of the remaining provisions.
