30-year warranty

GIS House and Garden Internetshop GmbH, Rathausstraße 4, 20095 Hamburg (hereinafter referred to as “OSKAR” or “we”) provides a voluntary manufacturer’s guarantee for its OSKAR stainless steel chimney kits and individual components in accordance with these guarantee conditions.

The guarantee applies regardless of whether the purchase was made directly through hello-oskar.de or through an authorised OSKAR distributor.

The guarantee is available both to consumers within the meaning of Section 13 of the German Civil Code (BGB) and to non-consumers (commercial or business purchasers).

OSKAR provides a two-tier guarantee covering the corrosion resistance of the stainless steel components:

1. Standard guarantee – 15 years

• Term: 15 years from the date of purchase (invoice date).
• Automatically included in the purchase price of every OSKAR chimney product.
• No registration required.

2. Guarantee extension – a further 15 years (30 years in total)

• Price: €89.00 net plus statutory VAT.
• The guarantee extension must be purchased together with the chimney; it cannot be purchased retrospectively.
• Purchasing the extension increases the total guarantee period to 30 years from the date of purchase.

The guarantee (both tiers) applies exclusively to the first end customer who purchased the OSKAR product, regardless of whether that customer is a consumer or non-consumer and regardless of whether the purchase was made directly from OSKAR or through an authorised distributor. The guarantee cannot be transferred to legal successors, subsequent owners or any other third parties.

1. Conditions

• Professional installation by a qualified specialist contractor or demonstrably correct installation in accordance with the OSKAR installation instructions.
• Compliance with the applicable state building regulations, firing regulations and relevant DIN standards.
• Exclusive use of genuine OSKAR components; no connection to ferritic steel or other inferior, corrosion-prone metals.

2. Exclusions

• Flexible pipes and moving components
• Wear parts, particularly sealing rings
• Insulation and other consumables
• Painted or otherwise coated parts
• Products or components from third-party manufacturers
• Damage caused by storms, flooding or other natural events
• Installation or transport damage
• Display models

• OSKAR must be notified of a defect in writing by email within two months of the defect being identified.
• The defect notification must include a detailed description of the defect, the name and address of the first end customer, and proof (proof of purchase/copy of the invoice) that the product was purchased by that person as the first end customer and the date on which it was purchased. If a claim is made under the guarantee extension, proof of its purchase must also be provided.
• Upon receipt of the written defect notification, OSKAR will contact the sender promptly.
• The affected product must not be removed before OSKAR responds unless there is a risk of significant consequential damage.

If there is a material or manufacturing defect covered by the warranty, OSKAR will, at its discretion, cover:

• the replacement or repair of the affected component free of charge or, at OSKAR's discretion, reimbursement of the purchase price of the affected component,
• the costs of shipping the component to and from OSKAR,
• the costs of installing and removing the affected component.

If it is determined that a warranty claim submitted is not covered by this warranty (e.g. because an exclusion under Section IV.2 applies or there is no defect), the customer shall bear the costs incurred in shipping or transporting the product, as well as the costs of inspection and any return transport.

In addition to the rights under this voluntary manufacturer's warranty, the first end customer retains all statutory rights in respect of defects against the contracting party without restriction. This warranty does not restrict any statutory rights.

The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). If you place an order as a consumer and your habitual residence is in another country at the time of your order, the choice of law in sentence 1 shall not affect the application of mandatory legal provisions of that country.

If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from or in connection with contracts between us and the customer shall be our registered office in Hamburg. However, we are also entitled to bring an action against the customer at the customer's general place of jurisdiction.

For customers who are consumers, the statutory place of jurisdiction shall apply.
